Description
Defence Commercial Air, part of the UK Ministry of Defence (“MoD”), intends to award a Contract to Datasoft Computing Ltd for the provision of the Defence Squadron Training Achievements Recording System (STARS). It is anticipated this Contract will be for three years, with two 1-year option periods. It is considered that this Contract can be placed using the Negotiated Procedure Without Prior Publication of a Contract Notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011) due to exclusive rights and technical reasons. This is because Datasoft Computing Ltd hold all IPR for the above System, and the MOD does not have access to the software code to enable competition to run STARS.
