The City of Wolverhampton Council (the Supervisory Body) is looking to commission service(s) from suitably qualified provider(s) who can offer the provision of Section 12 doctors Assessments to eligible customers to safeguard against an unlawful deprivation of liberty taking place. The Supervisory Body, under the terms of the Mental Capacity Act 2005 (MCA) and as amended by the Mental Health Act of 2007 (MHA) have a duty to ensure that Best Interest Assessors (BIAs) are available to complete a range of assessments in hospitals, care homes and nursing homes . The Deprivation of Liberty Safeguards are part of the Mental Capacity Act 2005, which provides the essential framework for people who need to make decisions on behalf of someone else who lacks mental capacity.
