Description

The new high speed rail line between London and the West Midlands, known as HS2, has received Parliamentary approval and initial survey works began early in 2017 as part of the preparation for constructing HS2. To facilitate the development of the proposed new line, a number of sites and properties within the ownership of the Council have been identified as being required. Notification of the intention to acquire the various sites and properties by HS2 Ltd has also been received. The Council now wishes to appoint a contractor to enter negotiations, on our behalf, to agree compensation on compulsory purchase terms and conditions. The Council have appointed an organisation to negotiate, on compulsory purchase terms and conditions, the market value of the interests of the various sites and properties held by the Council and any other compensation payments due. Provide an estimate valuation on full CPO terms, of all the Council's interests of the affected land and properties and any other associated compensation claims. Prepare a proposed strategy to include a timeline for individual compensation claims. Produce valuation reports in accordance with the RICS standards for approval. Submit an advanced payment claim to HS2 Ltd, on behalf of the Council, on notification of vesting or our instruction. Negotiate the compensation of all interest of the various land and properties together with any disturbance compensation claims. This would include the payment of the reasonable professional fees incurred in negotiating these claims. Provide the Council with copies of agreed Heads of Terms in order to issue instructions to the Council's Legal Services. Should terms not be agreed, and subject to approval from the Council, the contractor will be expected to refer and represent the Council to the Upper Tribunal for determination. Produce monthly spreadsheets reporting on the progress of each case.
