Description
Derby City Council is seeking to award a service contract to a single provider for an Integrated Sexual Health Service. An Integrated Sexual Health Service provides individuals with open access to confidential, non-judgemental services including Sexually Transmitted Infections (STI) and Blood Borne Viruses (BBV) testing, treatment and management; the full range of contraceptive provision; health promotion and prevention. It should be noted that other local authorities and public sector bodies may use this contract indirectly. This will occur when out of area users receive a service from the successful service provider and their local authority is re-charged for the service provided. The tendering of this contract may give rise to a possible presumption that the Transfer of Undertakings (Protection of Employment) 2006 regulations may apply in the event of this contract being awarded to a new Service Provider. Information relating to the Personnel currently employed by the incumbent Service Provider will only be disclosed to Tenderer's once they have signed the confidentiality agreement which can be found in appendix 8. Tenderers wishing to access the TUPE information provided to the Council will need to download and sign the agreement and return it to the Council via the messaging function on the e-procurement system. The TUPE information relates to both Derbyshire Community Health Services NHS Trust and University Hospitals of Derby and Burton NHS Foundation Trust personnel. The Council provides no warranty about the accuracy of this information or the actual legal position and therefore makes no representations about the applications of TUPE. Tenderers are advised to make their own enquiries by seeking independent professional legal advice on the consequences for them if they are the successful tenderer and the TUPE regulations do apply. There is a maximum budget of £2,211,000 per year for the first three years of the contract, and this is expected to be the same for any potential extensions. The Council may have to review and change the budget depending on any changes to the amount as part of the Council's budget setting process. The initial contract period is three years. The contract is estimated to commence on 1 April 2020 and expire on 31 March 2023. There will be an option to extend the contract for a further two years in annual increments, subject to funding, satisfactory performance and business needs. Maximum contract period is five years.
